The number of people diagnosed with asbestos caused diseases in the U.S. continues to increase. Experts believe 60,000 mesothelioma deaths will occur between 2010 and 2030.

Work related injuries harm up to 14 million people annually, with harms including traumatic brain injuries, spinal injuries, amputations, burns, and electrocutions. Around 20,000 to 60,000 workers die each year from accidents, toxins, and violence at their jobs.

Millions of consumers and workers are injured each year because of defective products. Defects can occur when a product is designed poorly, when a product is manufactured in a manner that differs from the intended design, or when the product does not contain proper warnings or instructions. Defects can occur in automobiles, pharmaceuticals, medical devices, construction equipment, toys, and other goods.

Between 1.5 and 2 million elderly reside in nursing home facilities, with studies revealing that 44% have suffered some form of abuse. Many believe the actual number of residents suffering abuse is much higher. Neglect and abuse may result in serious emotional, physical, and financial harm

Paul & Hanley’s legal team has produced some of the most notable verdicts and highest settlements in the United States. Over 500 of our clients have each obtained in excess of 1 million dollars. Over 250 have recovered multi-million dollar recoveries.

Asbestos & Mesothelioma News

A number of recent epidemiological articles have examined the relationship between asbestos exposure and mesothelioma. Epidemiology is the science that attempts to study causes and distribution of disease in various populations.

1. Significant Clustering of Mesothelioma Caused by Neighborhood Exposure to Crocidolite From a Large Asbestos Cement Pipe Plant in Japan by N Kurumatani and S Kumagai:    This study found increased incidence of mesothelioma among those living within ~ 2000 meters of Kubota's crocidolite plant.

2. Increased Risk of Lung Cancer Mortality Among Residents Who Had Lived Near an Asbestos Product Manufacturing Plant by S Kumagai et al.:  This study examined a plant using amosite and chrysotile to manufacture insulation and packing materials.  The authors found increased rates of lung cancer among residents of the area.

3.  Differences in the Environmental Exposure Pattern Between Peritoneal and Pleural Mesothelioma:  Data from the Mesothelioma Lombardy Region Register (Italy) by M. Bonzini et al.:  The authors examined the role of asbestos exposure in both pleural and peritoneal mesothelioma cases, finding that asbestos exposure is the main risk factor for both.

The Canadian government has spent millions of dollars supporting the Asbestos Industry.  As part of this support, The Chrysotile Institute has received annual funding.  The Institute is an Asbestos Industry lobbying group that promotes the use and export of chrysotile asbestos in developing countries.

Over 100,000 people die each year as a result of asbestos exposure.   The Canadian Cancer Society, health organizations, and universities, have repeatedly urged the federal government to cease funding of the Institute, noting that chrysotile asbestos causes cancer and other disease.

It is our view as Canadian experts in epidemiology and occupational medicine and as public health advocates that the Chrysotile Institute is endangering public health by disseminating misleading and untruthful information about chrysotile asbestos, especially in the world’s emerging economies. . . . The Institute puts forward the nonsensical, unsubstantiated claim that chrysotile asbestos disappears when it is mixed with cement and consequently becomes harmless not only now, but for all time to come. This distorted, out-of-date and out-of-context information is quite contrary to that from leading scientific institutions - such as the World Health Organization (WHO), the International Labour Organization (ILO), the U.S.  Environmental Protection Agency (EPA), the U.S. National Institute for Occupational Safety & Health (NIOSH), and the International Agency for Research on Cancer (IARC) regarding the health risks of chrysotile asbestos. These institutions, as well as the overwhelming worldwide scientific consensus, have called for chrysotile asbestos to be banned. The Chrysotile Institute censors reports from respected scientific bodies around the world, including Canada and Quebec itself, which state that chrysotile asbestos is a deadly carcinogen and that there is no safe use possible in the construction environment in developing countries. The Institute’s misleading propaganda is financed, in large part, by the Canadian federal government. It is a
slur on the reputation of the scientific community and people of Canada for the government to be funding such censorship and perversion of scientific information. But, this is a far more serious matter than a slur on our country’s scientific integrity. People’s lives continue to be put at risk if they put their trust in the Chrysotile Institute’s information.
(From 1/23/09 Letter to the Canadian Prime Minister From Scientists at Universite Laval, University of Ottawa, University of Alberta, Simon Fraser University, Mt. Sinai Hospital, and Rideau Institute.)

For the first time, the Canadian government recently announced it will cease its annual funding of the Chrysotile Institute.

LOS ANGELES - CA--(BUSINESS WIRE)--The nationally renowned Mesothelioma law firm of Paul & Hanley LLP announced a $5 million verdict against Specialty Electric Company, Inc., whose asbestos fibers were used in asbestos cement pipe handled by a 67 year old warehouseman who suffers from Pleural Mesothelioma caused by exposure to the asbestos cement pipe and to automobile brakes.

Following three days of deliberation, the jury awarded $5 million to the plaintiff and his wife, and assigned 18% fault to Special Electric.  Other settling defendants agreed to pay 2.7 million per confidential signed agreement.

Special Electric was part of a Wisconsin joint venture with Special Materials, Inc. which sold crocidolite asbestos from Africa to Johns Manville Corporation, who incorporated the asbestos into their asbestos cement pipe that was used for vent, sewer, and water transmission.  The plaintiff, who works for a piping supply company, and was exposed to the asbestos cement pipe from 1969 until 1979, has been married for 50 years to his wife who was a plaintiff in the lawsuit and received damages.   The plaintiff and his wife have three children and seven grandchildren.

The Paul & Hanley trial team was led by first chair trial attorney Anthony Vieira, and attorneys Campbell Filmer and Craig Peters assisted in the second chair role.  After a grueling six week trial in Los Angeles, California, Paul & Hanley LLP won the $5 million verdict for the plaintiff.  To know more about this case or for other additional information on this case please visit www.phhlaw.com

Asbestos mining is banned in India, but its use in manufacturing is not banned.  India's manufacturing industry obtains much of its asbestos from Canada.  Sadly, the result is a growing cancer occurrence in India.

This past month, several new developments have been reported concerning India:

1.  The Canadian government approved funding to expand Mine Jeffery in Asbestos, Canada, with the hopes of increasing its export to India and other countries.

2.  The development of 12 asbestos factories near Bihar, India has been met with strong protest by local residents and students. This opposition has been met by police violence.  Batons have been used to attack protesters, and on at least one occasion, police fired their guns.  This resulted in injuries to 3 farmers.

3.  India's Supreme Court was asked to ban asbestos use.  The Court declined to take such action, noting that the legislative body of India is looking at the issue.  However, the Court did take the opportunity to note chrysotile "is highly carcinogenic. . . . In India, it is imported without any restriction while even its domestic use is not preferred by the exporting countries. . . . Canada and Russia are the biggest exporters of white asbestos. In 2007, Canada exported 95% of the white asbestos it mined, out of which 43% was shipped to India. In view of these facts, there is an urgent need for a total ban on the import and use of white asbestos. . . it is clearly demonstrated that the Government is required to take effective steps to prevent hazardous impact of use of asbestos.”
