Because there are currently no pre-set limitations on the length of depositions in California, attorneys must be vigilant in protecting their clients from the abusive trend of extending depositions for absurd amounts of time, especially in the case of dying plaintiffs. As the authors point out, California’s practices buck the national trend toward limiting the total amount of deposition time.
