You have the right to a safe workplace. When faced with an unsafe workplace, you shouldn't have to remain silent. That's why we offer to act as a worker representative* for those workers who are fearful of complaining to OSHA. This is a free service for workers.
Congress passed the Occupational Safety and Health Act (OSHA) to improve conditions for workers. While improvements have occurred since its passage, 8 to 12 million workers continue to suffer from job-related injuries or illnesses each year.
Part of the problem lies in the fact that many workers are fearful of calling OSHA to complain about safety violations. Sadly, this fear may be valid, and recent reports show OSHA agencies are not properly investigating claims of illegal retaliation on "whistleblowers."
Employees or their representatives have a right to request an inspection of a workplace if they believe there is a violation of a safety or health standard or if there is any danger that threatens physical harm. Employee representatives, for the purposes of filing a complaint, are defined as any of the following:
An authorized representative of the employee bargaining unit, such as a certified or recognized labor organization.
An attorney acting for an employee.
Any other person acting in a bona fide representative capacity, including, but not limited to social workers, nonprofit groups, and organizations acting upon specific complaints and injuries from workers. 2223666Employees or their representatives have a right to request an inspection of a workplace if they believe there is a violation of a safety or health standard or if there is any danger that threatens physical harm. The AFL-CIO advises union members to rely upon their labor representative when safety violations occur. Representatives are able to file complaints, attend inspections, and obtain reports. They serve as a buffer between the workers and employers, too.
If you are not a member of a union, Law Offices of Jerry Neil Paul may be able to serve as your representative. In this particular role, our services are provided free of cost. Give us a call at 1-800-933-2244 to discuss the circumstances of your workplace.
*Law Offices of Jerry Neil Paul has licensed attorneys in CA, GA, IL, MN, NY, SC, WA, and WI. In these states, we may act as "an attorney acting for an employee." In other states, we may not "practice law" without first getting court approval. We can still contact OSHA on your behalf, however.
